This Privacy Policy explains how The Megaformer Studio (“we,” “us,” “our”) collects, uses, discloses, and retains personal information when you visit our websites, book classes, purchase memberships/class packs/retail, communicate with us, or visit our studios (collectively, the “Services”). This Policy also includes disclosures and rights for California residents under the CCPA/CPRA.

Applicability of This Privacy Policy

This Privacy Policy applies to all locations operated by the following entities:

  • Megaformer Studio Inc

  • Mega La LLC

  • Mega Miami Inc

  • TMS Austin LLC

  • Megaformer Inc

References to “Megaformer” “Megaformer Studio” “we,” “us,” or “our” throughout this policy collectively refer to these entities unless otherwise specified. Each entity may collect and process your Personal Information as described in this policy, depending on your interactions with their respective locations or websites.

SECTION 1 – Information You Provide to Us

Account Information.
When you create an account, sign up for communications, or otherwise engage with our Services, we may collect information such as your name, email address, phone number, mailing address, and (if applicable) account login credentials so we can communicate with you and provide the Services.

Scheduling / Booking Information.
To book a class, purchase class packs, memberships, or products through our Services, we may collect name, email, phone number, billing/shipping address, date of birth (if required by a booking platform or for age verification), and related booking details. You may also choose to provide information that helps us serve you better (for example, injury notes or fitness-related preferences), but you are not required to do so unless specifically needed for participation or safety.

Payment Information.
If you make a purchase through the Services (such as memberships, class packs, retail, or merchandise), you will provide payment details such as a credit/debit card number and billing information. Payment information is stored and processed by third-party payment processors (for example, the processor used by our e-commerce or booking platform). We receive limited payment-related details (such as payment confirmation and transaction identifiers) so we can fulfill your order and provide customer support.

Voluntary Information.
Information you provide voluntarily through website, megaformer app, lead forms, waitlists, newsletter sign-ups, surveys, promotions, events, reviews, customer service communications, or social interactions with us may include contact details, preferences, feedback, and any content you choose to share.

SMS / Text Messaging Information.

1) How to Opt In
If you opt in to receive SMS messages, we collect your mobile number and messaging preferences and may send messages via our SMS/CRM provider (e.g., AXLE).

Types of Messages You May Receive

If you opt in, you may receive text messages such as:

  • Class and membership announcements

  • Promotions, offers, and studio updates

  • Reminders and confirmations related to your account, bookings, or purchases

  • Customer service responses (if you contact us)

Message Frequency

Message frequency varies based on your interactions with us and the program you enroll in. We may send recurring messages.

Cost

Message and data rates may apply depending on your mobile carrier plan. Carriers are not liable for delayed or undelivered messages.

How to Opt Out

You can opt out at any time by replying STOP to any message. After you opt out, you will receive a one-time confirmation and no further messages will be sent unless you re-subscribe.

Consent Not Required to Purchase

Your consent to receive marketing text messages is not required to purchase goods or services from us.

Supported Carriers

Our SMS program should work with most major U.S. carriers; however, delivery is subject to carrier availability and your device.

Privacy

We respect your privacy. Your participation in our SMS program is subject to our Privacy Policy

We may use a third-party service provider (such as AXLE) to deliver text messages and manage our communications.

Changes to These Mobile Terms

We may update these Mobile Terms from time to time. The “Effective Date” above will reflect the most recent update. Your continued participation after changes means you accept the updated Mobile Terms.

Information Automatically Collected (Usage Information)

When you use our Services online, we may automatically collect information about how you interact with our websites and tools (“Usage Information”), such as:

Services Data.
Pages you view, links you click, features you use, time spent, referring/exit pages, and actions taken on our site.

Log Data & Device Data.
IP address, approximate location derived from IP, access times, browser type, device identifiers, operating system, crash logs, and similar diagnostic data used for security and performance.

Cookies and Similar Tracking Technologies.
We may use cookies, pixels, embedded scripts, and similar technologies to:

  • make our site function properly,

  • remember your preferences,

  • keep your account secure,

  • understand site traffic and performance,

  • support marketing and advertising measurement.

You can control cookies through your browser settings and (where available) our cookie banner/settings tool.

Membership and Studio Usage Information

If you attend classes or interact with our studios, we may collect information such as:

  • studios you visit,

  • check-in times,

  • classes booked or attended,

  • purchase history,

  • cancellations/no-shows,

  • communications with staff, and

  • other activity related to providing the Services.

Studio Security & Safety

Some locations may use security cameras for safety and loss prevention. Where cameras are in use, we may collect video images/likeness of individuals in common areas. We do not intentionally place cameras in private areas (such as bathrooms or changing areas).

Information from Third-Party Applications or Platforms

We may receive information about you from third parties when you interact with us through them, such as:

  • booking a class through a third-party platform (e.g., ClassPass, Gympass, or similar),

  • interacting with our ads,

  • referral submissions (where a friend shares your info),

  • analytics or advertising partners (online identifiers and usage data).

Job Applicant Information

If you apply for a job with Megaformer Studio, we collect information necessary to process your application (such as contact information, resume/CV, work history, education, and other information you provide). Employment-related data may be subject to separate internal policies.

SECTION 2 – HOW WE USE YOUR INFORMATION

We use Personal Information for purposes that include:

1) To Provide the Services

Including to:

  • create and manage accounts,

  • process bookings, memberships, class packs, and purchases,

  • provide studio access and class participation,

  • process payments and prevent fraud,

  • deliver customer support,

  • send service-related communications (e.g., confirmations, changes, receipts),

  • maintain a safe studio environment.

We cannot provide key parts of the Services without processing certain Personal Information.

2) To Communicate with You

We may send:

  • transactional/service messages (booking confirmations, receipts, policy updates),

  • marketing communications (email/SMS), where permitted and based on your choices.

You can opt out of marketing messages at any time (see Section 4).

3) To Improve and Grow Our Services

Including:

  • analytics and performance measurement,

  • debugging and feature improvement,

  • internal reporting and forecasting,

  • understanding member experience and studio utilization.

Where appropriate, we may use de-identified or aggregated information.

4) To Enforce Our Policies and Protect Rights

Including to:

  • enforce terms, rules, and policies (including cancellation/no-show policies),

  • protect our staff, members, and business,

  • detect and prevent security incidents, fraud, or misuse.

5) To Comply with Applicable Laws

We may process and disclose information where reasonably necessary to comply with legal obligations, lawful requests, or to protect rights, safety, and property.

6) De-Identified Information

If we maintain information in a de-identified form, we will not attempt to re-identify it except as permitted by law.

SECTION 3 – HOW WE SHARE YOUR INFORMATION

We may share Personal Information in the following ways:

1) Service Providers / Vendors

We use vendors to operate our business and provide the Services, including:

  • Website hosting and site tools (e.g., Squarespace)

  • Booking and client management (e.g., Mariana Tek)

  • CRM, email, and SMS communications (e.g., AXLE)

  • Payment processors, fraud prevention, and chargeback handling

  • Analytics, customer support, IT, and security vendors

These providers process data on our behalf to provide services to us.

Advertising, Analytics, and Marketing Partners

We may share certain online identifiers and usage information with analytics and advertising partners to measure performance and support marketing. Depending on how your browser and settings interact with these tools, some of this may be considered “sharing” for targeted advertising under certain laws.

Business Transfers

If Megaformer Studio is involved in a merger, acquisition, financing, bankruptcy, dissolution, reorganization, sale of assets, or similar transaction, information may be disclosed or transferred as part of that process, subject to applicable law.

Legal Obligations and Safety

We may disclose information if reasonably necessary to:

  • comply with law, court orders, subpoenas, or lawful requests,

  • protect the security or integrity of the Services,

  • protect the rights, property, or safety of Megaformer Studio, our team, members, or others.

With Your Direction / Consent

We may share information when you ask us to (for example, if you authorize a third-party platform connection or request information be shared with a partner).

User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials (including your username and password) and for restricting access to your computer, mobile device, and account. You agree to notify us immediately of any suspected unauthorized use of your account. The Megaformer Studio is not responsible for unauthorized access to your account resulting from your failure to safeguard your credentials or device.


SECTION 4 – YOUR CHOICES

Your Account

Where our booking platform allows, you may access and update certain account information through your account settings.

Voluntary Information

You can choose not to provide certain optional information (for example, you are not required to participate in surveys).

Email Preferences

You can opt out of promotional emails by clicking unsubscribe” in the email. Service/transactional emails (like receipts and confirmations) may still be sent.

SMS / Text Preferences

You can opt out of marketing text messages at any time by replying STOP (or any other method described in the message). You may still receive essential service-related messages where permitted (e.g., confirmations), depending on how you interact with our Services.

Cookie Preferences

You can control cookies through:

  • your browser settings (block, delete, or limit cookies), and

  • where available, our cookie banner/settings tool.

Note: disabling cookies may affect site functionality.

Do Not Track

Some browsers transmit “Do Not Track” signals. Our Services may not respond to “Do Not Track” signals consistently, as standards vary.

Global Privacy Control

California residents may opt out of “sale”/“sharing” using an opt-out preference signal such as Global Privacy Control where applicable.

SECTION 5 – THIRD-PARTY SERVICES

Our Services may contain links to third-party websites, embedded content, widgets, or integrations that we do not own or control. If you click a third-party link or use a third-party feature, their privacy practices govern. We encourage you to review the privacy policies of any third-party websites or services you use.

Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law.

General retention guidelines:

  • Website cookies/online identifiers & usage data: up to 5 years, then deleted or anonymized (unless needed longer for security or legal compliance).

  • Purchases/bookings/membership records: as needed to provide Services and for up to 5 years after your last activity/purchase (and longer if required for accounting/tax/legal obligations).

  • Customer support communications: up to 5 years.

  • Marketing preferences/opt-outs: kept as long as necessary to honor your preferences and prevent future messages.

  • Privacy request records: at least 24 months following completion of the request. 

SECTION 6 – California Privacy Rights (CCPA/CPRA)

If you are a California resident, you may have the right to:

  • Know/Access: request the categories and specific pieces of personal information we collected, used, disclosed, sold, or shared. 

  • Delete: request deletion of personal information (subject to legal exceptions). 

  • Correct: request correction of inaccurate personal information. 

  • Opt out of sale/sharing: request we stop “selling” or “sharing” personal information (as defined by California law). 

  • Limit use/disclosure of Sensitive Personal Information (when applicable). 

  • Non-discrimination: you will not receive discriminatory treatment for exercising your rights.

Your Privacy Rights

California Sensitive Information Disclosure. We may collect the following categories of sensitive personal information (as defined under California law): precise geolocation, account log-in in combination with a password, health information, and, in the context of employment applications, social security number, passport information, and driver’s license. This information is collected to process transactions, comply with laws, manage our business, or provide you with Services. We do not use such information for any purposes that are not identified within the California Privacy Rights Act Section 1798.121. We do not “sell” or “share” sensitive personal information for purposes of cross-context behavioral advertising.

Do Not Sell or Share My Personal Information

If we engage in “sale” or “sharing” as defined by California law (including certain targeted advertising activities), you can opt out by:

  • Using our Do Not Sell or Share My Personal Information link:

  • Enabling a browser-based opt-out preference signal like GPC (where applicable) 

SECTION 7– Sensitive Personal Information

“Sensitive Personal Information” can include things like precise geolocation, certain government identifiers, and financial account credentials. We do not intentionally collect sensitive categories unless needed to provide Services, comply with law, or you choose to provide it (e.g., optional safety notes). If we collect SPI, we use it only as permitted by law and you may have the right to limit certain uses.

SECTION 8– Your Choices

  • Account updates: You may be able to update certain information through your account/profile in our booking system.

  • Email marketing: Use the “unsubscribe” link in marketing emails.

  • SMS marketing: Reply STOP to opt out of marketing texts (message and data rates may apply depending on your carrier).

  • Cookies: Adjust browser and cookie banner/settings preferences.

Service/transactional messages (receipts, confirmations, critical policy/operational notices) may still be sent as needed to provide Services.

SECTION 9

Verification

We may need to verify your identity before processing certain requests (for example, by confirming information associated with your account).

Authorized Agents

You may use an authorized agent to submit requests on your behalf. We may require proof of authorization and may also verify your identity directly.

Employee and Contractor Confidentiality

We limit access to Personal Information to employees, contractors, and service providers who have a legitimate business need to know. Individuals with access to Personal Information are required to follow confidentiality obligations and applicable privacy and security requirements, and are subject to disciplinary action or termination of access if they fail to comply.

SECTION 10– Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child provided us personal information, contact us and we will take appropriate steps.

SECTION 11– Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure.

Security Breach Response

We maintain an incident response process designed to investigate, contain, and remediate suspected security incidents involving Personal Information. If we determine that a security incident results in unauthorized access to Personal Information, we will provide notices as required by applicable law and cooperate with appropriate regulatory authorities where required.

Our Services may include links or integrations to third-party websites or services we do not control. Their privacy practices govern their services, and we encourage you to read their policies.

We may update this Policy from time to time. We will post the updated version and revise the “Last Updated” date above.
